    PLEASE TAKE NOTICE Notice is hereby given that a public hearing will be conducted by the Culver Town Council on a proposed new Culver Zoning Map that reflects changes to the current map.

    On March 20, 2019 a public hearing by the Culver Planning Commission was held concerning a petition tiled by Cord Associates Ltd to rezone to Residential (R-2) from the current zoning of Suburban Residential (S-1) the following parcel located on West Cass Street: 502117000046000013 The request received a favorable recommendation by the Culver Plan Commission with a vote of 5 ayes and 0 nays. A public hearing by the Culver Town Council will take place on April 9. 2019 during the regular Town Council meeting to be helld at 6:30 p.m. that evening... Dated this 20th day of March 2019 ....

    AN ORDINANCE OF THE COMMON COUNCIL OF THE TOWN OF CULVER, INDIANA, ANNEXING TO AND BRINGING WITHIN THE TOWN LIMITS OF CULVER, INDIANA, CERTAIN LAND IN UNION TOWNSHIP

    Name of Petition: Bradley Smith on behalf of Cord Associates,Ltd. Common Address: W Cass St, Culver, IN, including the following parcel number. approximately 2.67 acres n total: 502117000046000013

    STATEMENT OF PURPOSEAND INTENT

    A Petition for voluntary annexation of 2.67 acres located in Union Township, Marshall County, Indiana, has been filed by 100% 0f the owners of the landin the territory sought to be annexed. It is the intent and purpose of this Ordinance to annex this territory to the town of Culver, Indiana

    THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CULVER, INDIANA AS FOLLOWS:

    SECTION I. That the following described real estate situated in Marshall County, Indiana, being contiguous by more than one-eighth (1/8) of its aggregate external boundaries with the present boundaries of the Town of Calver. Indiana, shall be and hereby is annexed to and brought within the Town of Culver
      Legal Description: A part of the Southeast Quarter of Section 17, Township 32 North, Range 1 East, Union Township, Marshall County, Indiana, described as follows: Commencing at a 1/2" iron rod at the Northeast corner of Lot Number Eleven (11) in George W. Garn's Addition to the Town of Culver, Marshall County, Indiana; thence North 0°00'00” East along, the West line of Slate Street, - 66.00 teat to a 5/8 rebar on the North line of Cass Street; thence South 89°49'39” West along the North line of said Cass Street, 440.00 feet to a 5/8" at the point of beginning; thence North 0°02'OO” West, 298.00 feet to a 5/8" rebar on the South line of a Parcel owned by Easterday Construction, Inc. as described in Deed Record 1980, page - 5639 in the Office of the Marshall County Recorder; thence South 89°49’39” West along the South line of said Easterday Construction Co. 391.32 feet to the West line of the East Half of said Southeast Quarter, thence South 0°14'44” East along said West line, 298.00 feet to the Northwest corner of a parcel owned by Larry Berger as described in D.R. 1991, page 2666 in the Office of the Marshall County Recorder, thence North 89°49'39" East along the North tine of said Berger parcel and the North fine of Cass Street, 390.04 tact to the point of beginning, containing 2.67 acres, more Or less.
    Subject to drainage easement described as the South Two Hundred Twenty-seven (2271)feet of the East Thirty (30') feet of the above described parcel.

    ALSO, subject to a drainage easement as described in Deed Record 1985, page 10395 in the Office of the Marshall County Recorder and any other casements of record,

    SECTION II. That the boundories of the Town of Culver, Indiana, shall be and are hereby declared to be extended so asto include the real estate of theabove described parcel as apart of the Town of Culver. Indiana.

    - SECTION III, This Ordinance shall be in full force and effect as of January 1, 2020

    SECTION IV. A fiscal plan for delivery Of municipal services to the annexed area is attachedan Exhibit A and related Exhibit ENACTED this 23rd day ofApril, 2019.
