had envisioned the whole lake front from Washington Street to South Plymouth street
lined with condominums until financial problems arose within the Harbor project.

The $14 million structure is still under construction. The restaurant May 1989. Permits will be held in

Culver, Ind. The first wing of an 80-unit "condotel"* will open on the shore of Lake Maxinkuckee
in December. Called Culver Cove, the condominiums are being marketed to people who will be able
to rent their units to visitors of the lake and nearby Culver Military Academy. "It fulfills a
need. All these parents come to the academy and they have no place to stay.
They have to stay in South Bend, which is 40 miles away," said John Deery. a local developer whose
partner in the project is Culver builder Charles Edgington.
Response has been strong, with 21 of the 26 furnished condominiums in the first phase sold for about
$100.000 to $200,000, said sales manager Michael Bozzelli.
The development company, called IID Corp., will offer a management service that will put the units up
for rent at $65 to $125 a night when the owners aren't using them.
The one and two-bedroom units range in size from 768 to 1.980 square feet and are sold fully furnished,
down to glassware and pillowcases. Condominiums in the second wing, to open in the spring, will range up
to 2,055 square feet and sell for as high as $259,900. Units contain decks, gas, fireplaces and whirlpool
baths.
A restaurant, exercise room and lobby also will open by spring. Conference rooms and a final wing of
condominiums are scheduled to be complete by November 1989, at a total cost of about $14 million.
The 6.2-acre lakefront site is within walking distance of downtown Culver, which has a population of about
1,500 people.
Deery and Edgington bought the land last March from a group of out-of-town investors who failed after nearly
four years of effort to develop factory-built condominiums on the site. The site, which most recently contained
vacant buildings used by an agricultural cooperative. was the last piece of prime land available for development
on the lake in Marshall County. About 300 homes are built around Lake Maxinkuckee, Indiana's second-largest natural
lake.
Deery, who developed the 20-unit Harbour condominiums on Lake Maxinkuckee in 1980-82, estimated Culver Cove will take
three years to sell out.
He is banking on selling many of the units to people associated with the academy, which is a major economic force in
Culver. The private, exclusive prep school enrolls about 2.200 boys and girls in its regular term and summer camp.

CULVER - Culver Cove Condotel Resort on Lake Maxinkuckee will employ a concept that developers say is
unique to northern Indiana. The term "condotel" indicates the development will combine features of
condominiums and hotels.
Richard C. Chambers, a salesman employed by the developers, said condo owners will be able to rent out
their condos when they are not using them. Chambers said this is a concept used in resorts in other
parts of the country and, especially, in Colorado ski areas and Traverse City, Mich. It is new to
Hoosierland.
The $15 million development on Lake Maxinkuckee will involve the construction of 80 condominium units, a
hotel lobby plus a restaurant-lounge.
The development covers 5.3 acres of land and has 842 feet of lake frontage. Condo units sell for $103,000
to $260,000.
Daily rents range from $75 to $175, with 65 percent of that going to the owner, thus reducing the cost of
owning the unit.
The first 26 condos have been completed; another 26 are due for completion in June; and the final 28 are to
be completed by winter.
The hotel lobby and the restaurant-lounge are due to be completed by July.
Chambers said condo buyers are not obligated to rent out their units. "It's completely at their option," he
said. "It's not a time-share arrangement. You ink in the times you know you would use it. We then
rent out the other times," said Chambers.
What happens if the owner suddenly changes his or her mind about using the condo at a specific time? "You can
call on Friday and say, 'Pull it.' If it is already rented, you have the opportunity to be placed in a comparable
unit at a substantial reduction in rates," Chambers said.
The hotel will be in operation 24 hours per day, year around. The condohotel is expected to employ some 50 people
year around, rising to 75 people in the summer.
Ordinarily, a lakefront resort in northern Indiana is plagued by the problem of short summers. That problem would
usually be intensified by the fact that Culver is such a small town, with a population of about 1,600.
However, people visiting the nearby Culver Academies are expected to provide a great deal of hotel business during
what is normaily the off-season for resorts. Culver Academies, located around the bend on Lake Maxinkuckee, is a
coed private school with 671 students.
Culver Cove is promoting the condos as offering convenience for those who use second homes sporadically. "The original
investment is smaller than an individual home. Also, the cost of maintenance and upkeep is shared. The result is that
the owner does not have the headache of taking care of maintenance," said Chambers.
Owners pay a fee for maintenance.
Culver Cove is located on property formerly occupied by the Farm Bureau Co-op grain elevator and the Penn Central Railroad.
Chambers said Lake Maxinkuckee, the second largest natural lake in Indiana, has excellent water quality. The lake covers
1,800 acres and is as deep as 90 feet.
"The lake is spring-fed, it has a sandy bottom and is an excellent sailing lake. It has good fishing, for perch, bass and
walleye," said Chambers.

Form is as important as function in the communications system at Culver Cove
Condominium Resort Hotel in Culver, Ind.
The clincher for Manager Sandra Underwood was that the Lexar 2000 phones from
Memorex Telex fit the decor of the upscale resort on the shores of exclusive
Lake Maxinkuckee.
"I looked at a lot things from the way the phone looked to what it would do," says
Underwood, recalling her phone system shopping. "This phone looked like us. It
looks stylish."
What makes Culver Cove different from most hotels in that all suites are
condominiums many of whose individual owners don't spend much time there.
The management company has to balance the interests of short-term guests, who
usually don't care how a phone looks so long as it works, with those of owners
who spend at least a little time in their Units and care about appearances.
That isn't to say that looks are all that matter.
"The Lexar had a lot more features, and we can add more than what we have now,"
says Underwood.
For instance, housekeepers could pick up a phone in a room to report that it has
been cleaned. That information would be relayed through the PBX to the Culver
Cove computer system.
That and other advanced features aren't needed yet, says Underwood, but "we will
need them one day. So we went ahead and got a phone system that can do all the
things we'll want it to do."
Data Transmissions
The eight-line, 80-phone system operates off a console at the front desk. Each
phone accomodates two lines. Computer users can plug in their Units for data
transmissions via modern. A privacy button blocks all incoming calls that could
interfere with data transfers.
Each room has one Lexar phone. Any extensions are ITT phones. The Lexars have eight
speed-dialing buttons to give owners and guests one-touch dialing to housekeeping,
the front desk, or the restaurant, for instance, and let them retrieve messages
that are indicated by a flashing light on the telephones.
Underwood's staff can also ring three extensions at a time by dialing one number,
which she says is handy when, for instance, they are looking for the restaurant
manager but aren't sure what phone he might be near. Any three extensions can be
programmed in by Culver Cove staffers.
Another feature lets the front desk get on the phone system in an emergency and make
an announcement over the speaker on the phone, regardless of whether any room
phones are otherwise in
Underwood says he is happy with $68,00 phone system; her only complaint is with the
electric eye in the cradle, which disconnects when the handset is set down.
Accidentally crossing the beam with your finger or while tapping a pen or pencil
during a call can bring that call to a quick end.
Culver Cove uses a RatePro call-accounting system from Com Dev, along with Epson
hardware and a Novell operating system for its reservations computers. Its four
computers are networked, from the front desk to the auditor's office and to
President John Deery's office, about a mile away.
800 Reservations Line
A toll-free reservations line provides 48-state access and a readout on the Lexar
PBX indicates whether the call is coming in on the 800 line.
Culver Cove's 80 Units range from 800 to 2100 square feet, with ownership prices
from $125,000 to $260,000. Per-night prices for guests range from $70 in the off
season in smaller rooms to $300 for larger rooms on busy summer weekends.
For condo owners, the per-night business means money in their pockets. The owner keeps
about half of the nightly rent. As Deery explains the condo ownership/hotel arrangement,
"It's an investment, but one you can get use out of."
Busiest weekends are those where special events are taking place at Culver Military
Academy, a short, walk from Culver Cove, along the lakeshore. The high-school-age
academy has 800 students during the school year (annual tuition: $16,000) and some
1400 during summer sessions.
Amenities are what differentiates Culver Cove from its competitors, the
garden-variety hotels and motels 15 miles or more away.
Available in most Units are hot tubs, kitchenettes, TVs with CVRs, second bedrooms,
queen-size convertible couches, gas tireplaces, motion-and heat-sensing lights--and
great views of the lake. There are also a heated indoor pool, sauna, weight room,
sand beach, and boat slips for use by all guests.
Lake Maxinkuckee is the second-largest lake in Indiana. The average home on its shore
fetches $400,000 on the market. If youcan find shoreline property, it sells for
$2500 a lakefront foot.
Culver Cove is the first condominium hotel of its type in Indiana. It opened last
fall. At press time, not all condo Units were completed, though all but a few were
sold.
It is zoned as a Planned Unit Development and is both private and commercial.

Indiana's Culver Cove is a gem of a getaway. This 80 unit condo resort is a unique blend
of big-city lucury and small-town friendliness that is delightful for a weekend juant or
a longer stay, for a vamily vacation or a romantic romantic rendezvous.
Modern-day stress seems to ease as you drive along Hoosier back roads to the little town
of Culver (about a twohour drive southeast of the Calumet Region).
There, the two gray and white New England-inspired resort wings look right at home hugging
the shore of Lake Maxinkuckee. From the circular entry drive, doors open into a soaring
atrium lobby with light wood, skylights, a rock garden and a profusion of plants.
The rooms are more impressive. Though no two units are decorated alike, all are spacious
lakefront suites with a private patio or balcony. They also have fully equipped kitchenettes
with top-ofthe line appliances (including a dishwasher and microwave), gas log fireplaces that
light with the flick of a switch, plush carpeting, hair dryers in the bathrooms, sofa beds in
the living rooms and such safety features as smoke alarms and sprinklers.
Some of the larger prime units are lavish enough for a movie set. Just imaginé a wrap-around
couch in the sunken living room and a staircase to the loft housing a second bedroom and bath
with a 6 1/2-foot whirlpool (the condo's own design).
And, since Culver all seasons, you can lazy as like. When the weather cooperates, you can rent a
boat or bicycle, go fishing, sit on a sandy or stroll along a sandy beach, play tennis or
stroll along the boardwalk.
The Snow bunnies can cross-country skiing look forward to and snowmobiling.
In any season, you can take a dip in the heated indoor pool or bask in the sauna.
Then curl up with a good book or cuddle with your true love in front of the dancing flames in your
own private fireplace.
Or perhaps you prefer letting the resort's spa relax and pamper you with a massage and facial or

A complex dispute over the repayment of a loan has resulted in a series of lawsuits
and confusion over the status of Culver Cove

CULVER - A dispute over the repayment of a loan involving Culver Cove, Ameritrust National
Bank and three former shareholders of the original company that developed the complex has
resulted in a series of complex legal maneuvers, three lawsuits and the filing of an
involuntary bankruptcy petition against the development.
But what has possibly caused more concern for the owners of the $15 million development on
Lake Maxinkuckee is the public's perception that Culver Cove is closing or will be forced to
close because of these actions.
Fred R. Jones, the Plymouth attorney representing the resort complex and its owners in the
lawsuits filed in Marshall County Circuit Court, said the resort has received calls from
businesses and individuals inquiring iftheir reservations and conferences should be moved to
another location. The owners of Culver Cove want it made clear the facility is staying open
while these proceedings are being worked out, Jones said.
In fact, Culver Cove has been open throughout the entire legal battle. The various disputes have
been ongoing for over two years. The legal action began, with charges filed in Marshall Circuit
Court by three former shareholders of IDD Corp., Culver Cove's original development company. The
shareholders claim they did not receive a proper share from a new company formed to develop and
manage the resort. That matter is headed for a full hearing following dismissal of the shareholders'
request for summary judgment.
The legal battle took its second step when Ameritrust filed a complaint in circuit court on April 13.
That complaint seeks the foreclosure on a loan made to the the new developers in December 1989. The
bank claims it loaned a total of $4.4 million and that $1.2 million of that principal and approximately
$200,000 in interest remains unpaid.
Culver Cove officials shortly thereafter filed a counterclaim against the bank, seeking a $10 million
judgment in compensatory and punitive damages.
That suit claims bank officials committed: a breach of fiduciary duty, fraud, negligence and breach of
contract in its dealings with the project. This, in turn, drove up the costs of the development, which
drove up the size of the loan.
Ameritrust and the former shareholders of IDD Corp. then joined together to file the involuntary bankruptcy
petition in the U.S. Bankruptcy Court in South Bend earlier this summer. That petition asked that the
development be placed in Chapter 7 bankruptcy and its assets sold.
According to bankruptcy law, there must be three or more entitled with a claim against the party in question.
That is why it was necessary for the parties to join in this matter.
Culver Cove Development Inc. is disputing the filing of the involuntary bankruptcy petition based on the fact
that three lawsuits in Marshall Circuit Court remain unsettled. The federal law does have a provision dealing
with debts that "are the subject of a bona fide dispute." The developers contended the lawsuits meet the "bona
fide dispute" criteria.
Jones said it was the filing of the involuntary bankruptcy petition and the ensuing publicity that prompted calls
to the developers about the Cove's ability to handle their reservations and conferences. It was then that developers
believed the public should be made aware that the development is, indeed, staying open.
Culver Cove is a condominium hotel and restaurant that opened its first phase of 1989. The development runs under the
concept that suites are sold to individuals. The suites are then rented to others when the owner is not using them.

CULVER - The Culver Cove CoOwners Association has dumped Culver Cove Management Co., the
original managers of the posh but troubled lake resort development.
The action came Thursday, the same day Culver Cove Management filed for voluntary Chapter 7
(liquidation) bankruptcy.
The Co-Owners Association announced today it selected an Indianapolis-based company as
operating manager of Culver Cove, a condominium resort development located on Lake Maxinkuckee.
Revel Cos. of Indianapolis was named to replace Culver Cove Management.
John R. Kissling Jr., president of the Culver Cove Co-Owners Association, explained in a
prepared statement why it replaced the former management.
Kissling said last November the developers of Culver Cove, John Deery and Charles Edgington, had
turned control of the resort over to the Co-Owners Association and had also given the owners'
group the right to hire a company to manage the property.
At that time, the Co-Owners Association had hired Culver Cove Management Co. as managers. "Since
Deery and Edgington had manage also formed Culver Cove Management Company for the express purpose
of operating Culver Cove, the logical choice was for the association to select this already
established firm as managers," said Kissling.
He said it then became apparent that Culver Cove Management was conexperiencing severe financial
problems. "This became public last manage spring when Ameritrust Bank filed a foreclosure suit
seeking payments in excess of $1.2 million dollars from the Cove's developers, the management company
and the Culver Cove restaurant, all of which are owned by Deery and Edgington," Kissling said.
"The Co-Owners Association then started intense negotiations with the management company pressing
them for accountability and business plans for solving their financial problems. During these
negotiations, it was discovered that the developers had also failed to pay some $60,000 in property
taxes on the cove," he said.
"The Co-Owners and management continued negotiations until Thursday afternoon when management declared
Chapter 7 bankruptcy and walked out while owing the Co-Owners sums in excess of $100,000. The Co-Owners
Association immediately replaced the management company with Revel Cos.," Kissling said.
In his prepared statement, Kisslthat ing added, "Of course we are conexperiencing cerned about the property
taxes and the debt which the managespring ment company left to us. We are, however, confident that the Cove
has such great potential and that the community is so enthusiastic about the replacement action, we will have
no trouble using this foundation estalished to improve Culver Cove from merely a fine resort to the truly
outstanding resort of the Midwest."
In June, a group of creditors of Culver Cove Management filed a petition in U.S. Bankruptcy Court seeking to
force it into involuntary Chapter 7 bankruptcy.
Culver Cove, which opened in 1989, is a $15 million development that includes a condominium hotel and a
restaurant.

despite the problems encountered by those who developed and formerly managed the resort,
according to John Kissling,
Kissling is president of the Culver Cove Co-Owners Association.
The financial difficulties encountered by Culver Cove's developers and former managers do
not directly involve the resort property itself, said Kissling.
"The owners association owns all the real estate. We merely hired the management company
to run it for us. It has been the management company that has had all the problems," Kissing
said. "And the management company is an outgrowth of the development company that built it.
"Everything is OK. The management company is out and they can settle that debt on the side
themselves," Kissling said. "The unit owners are now free and clear to operate the Cove
without that cloud handing over it."
Kissling is president of an Indianapolis insurance agency and owner of a condominium at Culver
Cove.
On Tuesday, Kissling announced the owners group had replaced Culver Cove Management Co. as
operating manager of the development on Lake Maxinkuckee. The new manager is Revel Cos. of
Indianapolis.
Culver Cove Management has experienced severe financial problems. In April, Ameritrust Bank
filed a foreclosure suit seeking more than $1.2 million from Culver Cove Management. Then in
June, a group of creditors attempted force Culver Cove Management into involuntary Chapter
bankruptcy.
Following the bankruptcy court action in June, an official of Culver Cove Management said it
would vigorously contest that action.
However, last Thursday Culver Cove Management filed a petition for voluntary Chapter 7
bankruptcy. On that same day, the condominium owners association dumped Culver Cove Management
and replaced it with the Indianapolis company.
Kissing said the developers did not pay off the debts incurred in building the project. "They
were causing a bad name for the Cove. We as unit owners wanted to be shed of the reputation they
were casting on us," he said.
There are 80 units in the development and all of them have been sold, Kissling said. Ameritrust
Bank owns 11 of the units, obtained from the developers in partial settlement of debt.
Under the condominium-hotel concept, owners of the condo units rent them out to the general public
when they are not using the units.
Units rent for $60 to $120 per night on weekdays and for $80 to $200 per night on weekends. Kiss|ing
said the units were usually sold out each summer weekend.
He said Ameritrust Bank has not elected to sell any of the condo units its owns but has been renting
