1951 - Jul 4 - Lake Property Holders Seek Injunction, Damages
A suit seeking an injunction and damages has been filed in the Marshall
Circut Court by a Lake Maxinkuckee South Shore property holder.
Robert J. and Tamer Discher, Union township property owners, VS John Klapp,
Owen Ringgenberg, and Henry Kosanke, commissioners of Marshall county, and
Roy Banta, county highway superintendent.
The plaintiffs, represented by O'Neil and O'Neil of Logansport, allege that
the defendants ordered highway department to enter their land and drive
stakes on their property.
They further allege that the department threatens to dig up the land to build
a roadway.
The plaintiffs seeks an injunction from, these actions and ask $5,000 damages.
1952 - Jul 10 - Court Sets Sept. 5th For Hearing- Arguments On Roadway To Lake Case
After hearing considerable evidence on both sides of the case of the Discher and
Discher vs. the Uoard of County Commissioners and the County Highway Superintendent
involving the question of a public roadway to Lake Maxinkuckee on the South Shore.
Judge Alvin Marsh set Friday, Sept. 5 at 1:30 p.m. as the time for formal arguments
on the issue.
The public hearing was conducted last week at Plymouth. The case is a continuation of
the proceedings which arose about a year ago when county road officials started to
drain and grade the roadway just east of the Discher cottage on the South Shore.
The plaintiffs filed suit at that time to enjoin the officials from going ahead with the
work.
The hearing last week was on the merits of the cast to determine if the plaintiff was
entitled to enjoin the officials.
The issue was to determine if there was a highway or not.
County officials offered evidence from witnesses to support the contention that it was a
public highway; the plaintiff offered witnesses to show that it was not a highway. -

1952 - Nov 12 - Judge Marsh Rules For Defendants In Lake Road Case
It was announced at the Marshall Countv Circuit Court at Plymouth this morning that Judge Alvin Marsh
had ruled in favor of the defendants in the case of Discher and Discher vs. The Board of County
Commissioners and the County Highway Superintendent.
The suit involving the question of a public roadway to Lake Maxinkuckee runs from the Farrar Road to
the lake east of the Discher cottage, on the south shore of the lake.
Attorneys representing Discher and Discher have formally objected to the Judge's ruling and conclusion,
and November 19, next Wednesday at 1:30 p.m. is the time which has been set to hear arguments.
Judge Marsh's ruling means that a roadway does exist at the disputed place.
The case is one which arose about 15 months ago when county road officials started to drain and grade the
roadway just east of the Discher cottage.
The plaintiffs filed suit at that time to enjoin the officials from going ahead with the work.
The proceedings were continued and considerable evidence was presented on both sides of the case in the
hearing which was held in early July. At that time the merits of the case were presented to determine if
the plaintiff was entitled to enjoin the officials.
