Resolution of Consolidation Culver Community School - 1960  

Notice of Resolution of Consolidation of Schools.

Notice is hereby given to the legal voters, taxpayers, and other interested parties of the

Town of Culver City, Marshall County, Indiana; and of
Union Township, Marshall county, Indiana; and of
Aubbeenaubee Township, Fulton county, Indiana and of
North Bend Township, Starke County, Indiana,

that on the 11th day of October, 1960, the Trustees and Advisory Boards of

Union Township, Marshall county, Indiana;
Aubbeenaubbe Township, Fulton county, Indiana; and
North Bend Township, Starke county Indiana,

at a joint meeting adopted a Joint Resolution declaring their intention to consolidate their respective' School Corporations.

That the said Resolution is in the following words and figures, to-wit:

Resolution

BE IT RESOLVED by the Board of Trustees of the School Corporations, they being

the Township Trustee and the Advisory Board of Union Township, Marshall County, Indiana;
the Township Trustee and the Advisory Board of Aubbeenaubee Township, Fulton county, Indiana; and
the Township Trustee and the Advisory Board of and North Bend Township, Starke county Indiana

that they do hereby declare it to be their intention to consolidate the elementary schools and the high schools of

Union Township, Marshall county, Indiana; and of
Aubbeenaubee Township, Fulton county, Indiana and of
North Bend Township, Starke County, Indiana

and to furnish consolidated school faculties for the children of school age of such corporations.

BE IT FURTHER RESOLVED that they ho hereby adopt this Joint Resolution to consolidate their respective schoolcorporations pursuant to Chapter 123 of the 1947 Acts of the Indiana State Legislature, as amended by the Acts of the 1949 Indiana State Legislature and pursuant to statute, the said School Trustees do herby set out the following information concerning said proposed consolidation and do hereby resolve as follows:

1. That the name of the proposed new School District shall be CULVER COMMUNITY SCHOOLS

2. That the number members of the School Board shall be five (5), all of whom shall be appointed, and the method of appointment shall be as follows:

(a) Union Township, Marshall county, Indiana shall appoint one (1) member.

(b) The Adivosry Board of Aubbeenaubee Township, Fulton County, Indiana shall appoint one (1) member.

(c) The Adivosry Board of North Bend Township, Starke County, Indiana shall appoint one (1) member.

(d) The Board of Trustees of the incorporated Town of Culver City, Marshall county Indiana shall appoint one (1) member.

(e) The fifth member shall be appointed by the The Adivosry Board of Aubbeenaubee Township, Fulton County, Indiana and North Bend Township, Starke County, Indiana for alternate periods as hereinafter more specifically set out under the provisions of Paragraph 4 of this Resolution.

3. That the Consolidated School shall be under the direction of a Superintendent selected by the Board.

4. All five members shall be residents of the area comprising the Consolidated School Corporation and of the area from which the shall receive their appointment.

Each member must be a resident voter of such territorial unit for a period of not less than five (5) years prior to the time of his or her appointment and at the time of the appointment shall be a freeholder of the territorial unit from which he or she is appointed.

If such member moves from the territorial limits of the unit from which he or she is appointed, it will automatically create a vacancy which will be filled for the unexpired term by the Board making the original appointment.

Each member, after the first members have been appointed, as hereinafter set out, shall be appointed for a term of four (4) years. Any member may succeed himself in office, but it is specifically limited to one (1) succession, to the end that no member shall serve more than two (2) successive terms.

The first members appointed shall be upon the following basis,

(a) The member to be appointed by the Advisory Board of Union Township, Marshall county Indiana shall be for a periord of four (4) years.

(b) The member to be appointed by the The Adivosry Board of Aubbeenaubee Township, Fulton County, Indiana shall be for a period of two (2) years.

(c) The member to be appointed by the Adivosry Board of North Bend Township, Starke County, Indiana shall be for a period of one (1) years.

(d) The member to be appointed by The Board of Trustees of the incorporated Town of Culver City, Marshall county Indiana shall be for a period of three (3) years

(e) The fifith member shall be appointed as follows:
The first member shall be appointed by the Adivosry Board of North Bend Township, Starke County, Indiana . He shall be appointed for a perod of four (4) years and must be a resident voter of North Bend township. At the expiration of the four-year term the vacancy then created at the end of such term shall be filled by the Adivosry Board of Aubbeenaubee Township, Fulton County, Indiana He likewise, shall be appointed for a period of four (4) years and must be a resident voter of Aubbeenaubee township, Fulton county Indiana. He shall serve for a period of four (4) years and

at the expiration thereof the member shall alternate, first North Bend township, then to Aubbeenaubee township, and in this order from then on.

In all other aspects the member selected to cover this fifth member must comply with the qualifications as herein specified. In the event a vacancy occurs for any reason, the member appointed to fill such vacancy shall be for the unexpired term of the previously appointed member.


Those members of the Board to be first appointed shall take office on the first day of August, 1961. They shall be appointed within five (5) days after the consolidation becomes effective, as a result of this Resolution and the provisions of the statute.

There after all appointments to be so made for the full four year term shall be made by the respective appointing bodies sometime in the month of June prior to the August 1st when the shall start their tenure of office. Vacancies occurring during the time of the incumbent’s appointment shall be filled as son as possible after the vacancy occurs

5. The names of the present School Corporations which are to be merged to gether as a Consolidated School Coroportation as a result of this Resolution are as follows:

(a) Union township School or Marshall county, Indiana
(b) Aubbeebaubbee township Schools of Fulton county Indiana
(c) North Bend township schools of Starke county Indiana

You, and each of you, are further notified that the statutes of the State of Indiana under which said proposed consolidation is being considered, provides that on or before the sixth day following the last publication of such notice of intention to consolidate, fifty legal voters, residing in any of such School Corporations, may petition the School Trustees of the respective School Corporation for an election to determine whether or not the majority of the voters are in favor of such consolidation.

In the event of such a petition or petitions might be filed, the Trustees in each such School Corporation in which such protest petition is filed, shall call an election of the voters of such School Corporation, for the purpose of determining whether a majority of the legal voters of such Corporation are in favor of consolidating said School Corporations. The election sall be held on the same day.
