These properties for years had the railroad between them and the lake till about
late 1970's or early 1980's when it was abandoned and the property owners bought
the railroad right-a-way back. This is indicated by a a stip of land decribed as
generally: "PRT W1/2 NW1/4:COM W1/4 COR E..." most have since been re-surveyed
making them into one lot.
Spoke with Verl the Barber today (12 Sep 2012 ) he told me how the railroad came
up with deeds for the property running through Culver located in an office at
Marion, Indiana (I assume he said Marion) and how that they wanted $125.00 per
lake front footage from each cottage owner - they banded together got a lawyer
and got it for much less .

The secretary is requesting POST dated checks for November 1, 1981 payable to the
TREASURER, MARSHALL COUNTY for the amount listed to your name.
The purpose of this is o consolidate the payment because the tax receipt is in the
name of the corporation.
There are only four tax receipts for our right of way.
Following the Stockholders Meeting August 31 c , 183, your Board of directors met
and elected the fo11owing officers:
President - Larry Berger
Vice president - Bonnie McKinney
Secretary-treasurer - Dorothy Barnes
On May 24, 1981 your Board of Directors had a meeting.
This is brief summary of that meeting. It was decided that those persons (members and
non-members who advanced money more than was needed to purchase their land will be paid
ten percent interest according to the length of time the money was on hand.
The balance on hand will be distributed to stockholders on the final dissolution of the
corporation.
It was suggested we may want to continue an ASSOCIATION but not a CORPORATION.
We shall need a stockholders meeting in order to dissolve the corporation. .
It is essential to continue the corporation until the real estate taxes due in November
1981 are paid, as above explained.
There will be a Stokholders' Meeting at Bonnie McKinneys on Sunday August 30, 1981. Please
bring your own chairs. The meeting will be held at 2 P.M.

Dear West Side Property Owner member:
It s thought that you might be interested in a progress report.
As per purchase agreement with Penn Central, the corporation is to pay the first half of 1980
taxes due in 1981. This has been done.
The sales agreement specified that the Corporation should pay the second half taxes, and
by then, the record books will have been changed so that the 1981 bills due in 1982 will
come to the individual owners.
Money was withheld from the purchase money to pay the first half of 1980 taxes. We did not
get title to the property until the middle of the year.
$1623.54 has been paid (May 10th payment) for 3157.51 feet of right of way. That figures
out to $.51418364 per linear foot. Using that figure it has been determined what each owner
will have to pay in November, according to the following table:

WHO OWN LAND ADJACENT TO THE ABANDONED RIGHT OF WAY OF THE PENN CENTRAL
CORPORATION
We assume that each of you have received a notice from the Clerk of the Court of
Marshall County that the above class action suit has been filed.
This includes everyone who owns property adjacent to the abandoned right of way
of the Penn Central Corporation.
The Board of Directors met yesterday. The corporation cannot act as an attorney.
We recommend that you, individually, sign and file an exclusion, in writing,
referring to the above Cause Number CTC 81-222 at the Marshall Circuit Court
Clerk's Office, Plymouth, IN 46563.
We believe it is especially important that owners of land abutting street ends
(Davis Street and Winfield Street) are cognizant of the class action.
Questions should be referred to your own attorney.
Enclosed is a sample letter which could be sent or taken to the Circuit Court
Clerk. This letter must be filed before July 16 in order to be excluded from
the suit.
