	January 7th 1895 Be it rememebred that the Town Board of the Town of Marmont met on the the day of January 1895 at 7 P.M. Present John W. Souder Marcus F Mosher and Samuel E Medbourn The following petition was presented and read. Whereas the Town of Marmont was incorporated on the 5th day of July 1894, and in order to carry into effect such incorporation and to conduct the governement of said town, it has become neccessary to raise the sum of Four hundred dollars. and, Whereas some doubt exists as to the power of the Board to make an immediate levy of taxation on the taxable property within the limits of said town. Therefore, we the undersigned being a majority of the resident tax payers of said town owning real estate therein petition the Board of Trustees of said town to negotiate a loan for said town of the sum of Four hundred Dollars due and payable in Four years from the date, at the best rate possible for them to secure the same. 	Elizabeth Duddleson Sarah E Gandy Mary R Reed Mrs. E Duddleson Jacob Patsel State of Indiana, Marshall County S.S. Henry M. Speyer being duly sworn on his oath says that the signatures to the attached petition are genuine and that there are attached to said petition the signatures of the majority of the resident owners of taxable real estate in the town of Marmont, Indiana and further he saith not. Henry M. Speyer Subscribed and sworn to before me this 31st Day of December 1894 Oliver Morris, Justice of the Peace And be it further remembered that the following resolution was presented and read by Marcus F. Mosher. Where as it appears by petition duly verified as by law provdided and signed by the majoirty of the resident free holders of the town of Marmont Indiana that authority is given to the trustees of said town to negoiate a laon of Four Hundred Dollars: Therefore be it resolved by the Board of Trustees of the Town of Marmont Indiana that the clerk of said town be and is hereby authorized to negotiate a loan for said sum of Four Hundred Dollars due at four years at the lowest rate of interest he can obtain the same for and that this Board be said above provided Marcus F Mosher Trustee
	and it was moved by said Mosher which motion was seconded by Samuel E Medbourn that said resolution be passed and adopted as read. The yaes and nays were taken on said motion. Trustee Mosher and Medborn voting in the affirmative and the President John W. Souder declared said motion carried and said resulution adopted and the clerk was ordered to negotiate said loan in conformity with said motion And be it further rememeberd that the following petition was presented by the school Trustees of the Town of Marmont. Marmont Ind. Jan 7th 1895 To the Trustees of the Incorporated town of Marmont Indiana We the School Trustees of said incorportation do hereby file with you the following statements 1st That in our opinion it is desireable and necessary for the educational intersest of Marmont to have erected a shool building to accomodate those of our pupils who desire to pursue the higher branches after grauating in the common branches as termed in our public schools and so that the grades may be better accomodated with room 2nd The present building being in our opinion insufficient for the demands now existing our duty in thes reagard is lain down in Sec. 4497 Notes 1 and 2 also Sec 4491 Ind. School law (1894). And further more in as much as the financial condition of the town demands economy in expenditures and as
	it will be for the best interests of our schools we desire to establish a joint grade school with Union Township as provided for in Sec. 4446 Indiana School law. The Trustee of Union Township having signified by approval of said joint grade school. We have estiomated the cost of said building to be $2000.00 , $1000.00 to be paid by each corportation. Before making building contract with said township trustee of a contract or arranging for joint ownershio of suitable grounds for such building as directed in sec 4446 Indiana School law. We submit this statement to you for your approval as directed by law sec 4491. We also ask that you guarantee to us that bonds shalll be issued for said amount and such purposes as above names as provided in Art 6 Sec 4488. Signed this 7 day of Jan 1895 O. A. On motion of Marcus F Mosher which motion was duly seconded by Samuel E Medbourn the above petition was approved and the Presdient John W Souder directed the school trustees to proceed with the work. The board guaranteeing the issue of the bonds for the purpose as above stated
	and be it further remembered that Thomas Medbourn a resident of the Town of Marmont was duly appointed by said Board as secretary of the Board of Health for said town to serve until his seccessor is elected and qualified, the salary of said Medbourn to be $12.00 per annum. Marmont Indiana January 8th 1895 This is to certify that Thomas Medbourn was on the 7th day of January 1895 duly appointed secretary of the Board of Health of the Town of Marmont Indiana by the Board of Trustees of said Town to have and to hold said office until his successor is appointed and qualified. Thomas Medbourn being duly sworn upon his oath says he will uphold the Constitution of the United States and the Consititution of the State of Indiana and that he will honestly faithfully and impartially discharge his duties as secretary of the Board of Health of the Town of Marmont Indiana according to law and to the best of his ability so help him God. 	And be it further remembered that the following bill was the presented Marmont Indiana Jan 7th 1895 Town of Marmont Dr to F. L Carl Postage Stamps $0.30 Sept 20th car fare     .55 dinner     .25 Oct 12th car fare     .55 dinner     .25 Dec 12th Car Far     .55 total $2.45 On motion by Marcus F. Mosher which motion was duly seconded and carried the above biill was allowed And be it further remembered that for the benefit of parties desireing to build side walks the Board decided that all board walks should be 6 ft. wide of sound white oak timber each plank to be 1 1/4 inches thick by 6 inches wide and dressed on one side, to be supported by 4 stringers each 2X4 inches and of sound white oak timber. And be it further remembered that that the Board of Trustees instructed the clerk to draw the orders for the salaries of of the different officers of the town. F. L Carl, Clerk John W. Souder Pres.
	March 4th 1895 Be it remembered that the Town Board of the Town of Marmont met of the 4th day of March 1895 at 7 P.M. Present John W. Souder Marcus F Mosher and Samuel E. Medbourn. The following bills were presented and read. Marmont Ind. February 13th 1895 Town of Marmont Dr. to Urias Menser Nov 26th 1894 to pipe $1.10     29th       1 Share     .50      30th      8# 40d. h. nails     .20 Dec  3         1# 20d            .03 Dec 20        8# 20d  "          .20 $2.03 Motion made by Marcus F Mosher that said bill be allowed and an order drawn for that amount which motion was duly seconded and carried Marmont Jan 16th 1895 To Common Council to Geo. Nearpass Dr. for printing 500 receipts for Marshall Gandy $2.00 On motion which was duly deconded the above bill was allowed and the clerk was instructed to draw an order for that amount. And be it remembered that the following report was present and read Comes now F. L. Carl Clerk of the Town of Marmont and for his report in and concerning the negotiation of a loan of Four hundred Dollars for said Town of Marmont as heretofore directed and authorized by the Board of Trustees, says that he negotiated a laon for the sum of Four Hundred Dollars at the rate of eight per cent
	per annum from date, that beinf the best rate of interest that he could get and presnted a note to the Board of Trustees a copy of which is as follows. Marmont, Ind. Feb 25th 1895 Four years after date the Town of Marmont, Indiana promises to pay to the First National Bank of Marshall County, or order the sum of Four Hundred Dollars value received without releif from valuation and appraisement laws and with interest rate of 8 percent per annum from date payable annually and attorney's fees. Privilege is given to pay not less than $50.00 per annum to be applied on the principal of this note. The Town of Marmont by John W. Souder  } Sam E Medbourn} Trustees M. F. Mosher       } Attest F. Carl, Clerk That said note was duly signed by the members of said Board as appears by said copy and he procured the sum of Four hundred Dollars from the First National Bank of Marshall County and deposited the same to the credit of the Treasurer of siad Town and files his receipt herewith and makes the same a part of thie report. 	He asks that his proceedings here in may be approved Dated March 4th 1895 F. L. Carl Comes now F. L Carl, Clerk and files with this Board his report concerning his doings in making a loan of Four Hundred Dollars for said Town and it is moved by Marcus F Mosher Trustee, which motion was duly seconded and carried that said report be received approved and made a part of the record. 	March 18th 1895 Be it remembered that the Town Board of the Town of Marmont met on the 18th day of March 1895 at 7 P.M. Present John W Souder Marcus F Mosher and Samuel E Medbourn. The Following ordinance was presented and read by trustee Samuel E. Medbourn which ordinance is number five (5) An Ordinance Regulating the cinstruction and repair of Side walks in the Town of Marmont, Marshall county Satae of Indiana Sec. 1 - - Be it ordained by the Board of Trustees of the Town of Marmonty that all side walks in said Town shall here after be constructed and repaired according to the specifications and requirements of this ordinance and not otherwise Sec 2 - - Any person violtating the provisions here of upon conviction before any Justice of the Peace in said town shall be fined not more than Twenty five dollars nor less than five dollars. Sec 3 - - All side walks to be made hereafter in said town shall be constructed of White Oak or Burr Oak lumber, cement, paving brick or dimension stone. Sec. 4 - - All side walks in said town constructed of lumber shall be made of board laid cross wise on net less that three oak stringes such stringes to be not less than two inches thick and four inches wide such board shall be not l ess than one and one quarter inches thick nor more than six inches wide.
	Sec 5 - - All side walks to be not less than five feet in width Sec 6 - - All Side walks hereafter built shall be constructed with the outer line of such walk or walks five feet from the front line of the lot or lots adjacent to which they are consturcted Sec 7 - - The drae of all side walks hereafter constructed in said town shall be and conform to a line eight inches above the sub grade of the street or streets or which the are built unless the grade shall be fixed otherwise by the Board of Trustees of said town in any particular case or cases. In all cases the ends of side walks hereinafter constructed shall be carred to a level of the adjoining side walk or side walks by an easy slope so that the assent or desent shall not be dangerous to foot travelers. Sec 8 - - All side walks hereinafter built under this ordinance and all repairs that may be ordered on said walks shall be made under the supervivion and subject to the inspection of the Marshall of said town who shall report in writing his approval or disapproval of such side walk or side walks or repairs made thereon which report shal be entered on the records of said town. Sec 9 - - Whenever any person or persons may be ordered to build a side walk or side walks or who be resolution of the Board of Trustees of the town of Marmont, Indiana shall be ordered to repair any side walk or side walk, and shall fail to do so as prescribed in
	this ordinance or as may specified in a resolution as aforesaid after ten days notice in writing the Marshall of said town shall proceed to build or repair said Walk or walks as the case may be at the cost of the owner or owners aforesaid and shall keep an account of the cost and expenses necessarily incurred in so doing Sec 10 - - It shall be the duty of the town Marshall of said town under the direction of the Board of Trustees of said town to oversee the construction and repairs of all side walks in said town, and whenever in the opinion if said town Marshall it shall be necessary to construct of repair any side walks he shall report such fact in writing to the Board of Trustees of said town for their action specifying the place and kind of work necessary. giving the number of the and the name of the owner thereof it a new walk is to be constructed or if repairs to be made and the probable cost thereof. If the Board of Trustees shall order such walk or walks constructed or shall order such repairs made as are reported by the town Marshall it shall be the duty of such board to cause a notice to be given to the proper party or parties or their agent or agents in writing. signed by the president of said Board and attested by the clerk thereof which notice shall be served on the owner or owners of such lot or his or their agent or agents if known. A service of notice upon the occupant of the premises shall be deemed sufficient notice
	under this ordinance and in case the owner or his agent is not known or is a non resident of the county and there is no occupant of ssaid premises said notice shall be published in two consecutive issues of some weekly paper published in said town and in case no paper is published in said town then such notice shall be published in some weekly news paper of the city of Plymouth, Indiana Sec 11 - - Whenever any person or persons here been notified as required by this ordinance to make repairs on any side walk as provided for in this ordinance and shall fail or refuse to do the same it shall be the duty of the town Marshall to case the same to be done at the expense of such person or persons keeping an itemized account thereof and all costs of notice fees and charges of such town Marshall shall be deemed to be a part of and taxed as a part of the costs of such construction or repairs. Sec 12 - - Whenever any side walk shall have been constructed or whenever ahy repairs shall have been made by the town Marshall as as aforesaid he sll report in writing the entire costs fees and expenses thereof at the first meeeting of the Board of Trustees of said town after such side walks shall have been constructed or after such repairs shall have been made and such report shall be spread upon the records of said town and said costs, fees and expenses shall be allowed and paid
	by said town and become a lien upon the lot or fraction there of along which such side walk shall have been built or such repairs shall have been built or such repairs shall have been made and the Board of Trustees of said town may at once institute proceedings in any court of competent jursidiction and the collection of such corst fees and expenses together with a reasonable attorney's fee and such Board may take such other steps for the enforcement of the payment of said claim as are authorized by law for the collection of debts. This Ordinance shall take effect form and after passage and publication. And it was moved by said Medbourn that said ordinance be place upon its final passage which motion was duly seconded by Marcus F Mosher and the yaes and nays were taken upon said moition Trustees Medbourn and Mosher voting in the affirmative and the president of said Baord John W Souder declared said motion carried. It was then moved buy said Trustee Samuel E Medbourn that said ordiance be passed and adopted as read which motion was seconded by Marcus F Mosher and the yaes and nays were taken on said motion. Trustees Mosher and Medbourn voting in the affirmative amd the president of said Board John W. Souder declared said ordinance passed and adopted. It was then moved by said Medbourn that the clerk be autorized and instructed
	to publish said ordinance in the Marmont Hearal a paper published in the town of Marmont for three successive publications which motion was seconded by Marcus F Mosher and the yaes and nays were taken on said motion Trustees Medbourn and Mosher voting in the affirmative and the presiden of the Board John W Souder declared said motion carried an ordered he clerk of said Board to publish said ordinance in conformity with said motion And be it further rememberd that the following bill was presented and read Marmont Ind. March 18th 1895 Town of Marmont Dr to Nathaniel Gandy for services as overseer of road work $15.00 Nathaniel Gandy Motion made by Marcus F Mosher that said bill be allowed and an order be drawn for that amount which motion was duly seconded and carried. 	April 1st 1895 Be it remembered that the town Board of the town of Marmont met of the 1st day of April 1895 at 7 o'clock P. M. Present John W. Souder Marcus F Mosher and Samuel E Medbourn. Motion made that the public school house be the place designated by the Board as the place for holding the town election which motion was duly seconded and carried Motion made that the clerk be instructed to publish a notice of the town election to be held May 6th 1895 which motion was duly seconded and carried. 	April 15th 1895 Be it remembered that the town Board of the town of Marmont met on the 15th day of April 1895 at 7 o'clock P. M. Present John W Souder Marcus F Mosher and Samuel E Medbourn The following communication was presented and read Marmont Indiana April 15 1895 I the undersigned consider the horse paddock in the rear of the dwelling in which I live a public nusance and a disgrace to the town of Marmont Indiana and I ask that you honrable body will have the same removed at once. L. C. Wiseman Druggist Motion made by S E. Medbourn that the Marshall be instructed to notify Wm Kepler that the Town Board considers the horse paddock which is under his control a public nusiance and that said Marshal notify said Kepler to remove the same or otherwide conform with the law on the subject said motion was duly seconded and carried And be it further remembered that the following was presented and read by the town Marshal Marmont April 15, 1895 To the honroable Town council of the Town of Marmont. Gentlemen I hereby recommed that side walks be built in the said town of Marmont as follows towit.
	commencing at the cross walk that extends from the Collonnade hotel to the Vandalia depot platform thence west on both sides of Toner Ave. and Scott street until they intersect Main Street thence south on both sides of Main Street to Madison street thence south on west side of Main Street and Pplymouth and WInamac road to the southern line of the lots now owned by Marcus F. Mosher Also commecing at the North east corner of the lot upon which the M. E. church now stands that being the south side of Washington St. and west side of Main St. thence east along the south side of Plymouth St. thence north to the north side of Washington St. thence east along the north side of Washington St. and across the old Plymouth and Winamac road to the north west corner of Mill lot owned by Thomas B Harris thence east along the north line of said mill lot until a point is reached directly south of the south west corner of the Kreuzberger Park thence north to the south line of said park until it intersects the line of the Vandalia Rail road. 	Mosher the yaes and nays were taken on said motion Trustees Mosher and Mednourn voting in the affirmative and the president of the Board John W. Souder declared said motion carried Motion made by Samuel E Medbourn that all cross walks be built of gravel except on the south side of Jefferson Street running from the north west corner of _ M & Co's lot across to the north east corner of lot owened by Oliver Morris also from the south west corner on Mensers hardware store across to the south east corner of lot owned by Mrs Ellen Overman From th north west corner of lor owned by John W Cromley across to the north east corner of lot on which the M. E. Chruch stands From the north east corner of the lot owned by Cha. Stall across to the sourth east corner of lot owned by J. P. Garn From the south east corner of lot owned by Selia Canshoiack across to the north west corner of lot owned by R. Kreuzberger Which motion was duly seconded and carried. 	motion made that said bill be allowed and an order be drawn for that amount which motion was dulyt seconded and carried Marmont Ind. April 13th 1895 To the Honroable common council of Marmont Ind. To printing side walk ordinance in Marmont Hearld thee weeks commencing March 29 and ending Apri 12. twelve folios at 75cts. first insertion and 40 cents subsequrnt insertions making a total sum of $18.60 Geo. 	April 25th 1895 Be it remembered that the town Board of the town of Marmont met in special session on the 25th day of April 1895 at 1 Oclock P. M. in response to the following notice Notice To Marcus F Mosher and Samuel E Medbourn that a special meeting of the Board of Trustees of the town of Marmont Indiana will be held at Mosher boat house in said town on the 25th day of April 1895 at 1 O'clock P.M. for the purpose of appointing an inspector of elecetion to confirm the appoinment of deputy marshalls as made by the town marshall. Souder Pres April 25th 1895 We hereby acknowledhe sevices of the above notices upon us for the purposes there in expressed Marcus F Mosher, Trustee Present at said meeting Marcus F Mosher and John W Souder On Motion by Marcus F Mosher John F Koontz was appointed inspector for the Town election to be held on May 6th 1895. The appointments of deputy Marshalls to seve at said election of John Medbourn and Frank Cromley as made by Marshall Gandy were confirmed by the Board On motion said board Adjourned. 	May 6th 1895 Be it rememebered that the Town Board of the town of Marmont met on the 6th day of May 1895 at 7 o'clock P.M. Present John W. Soufer Marcus F Mosher and Samuel E Mebourn The following bills were presented and orderd paid Marmont Indiana May 1st 1895 To common council City of Marmont City of Marmont Printing election notice commencing with No. 39 and endingn in No 41 of the Marmont Hearld(three weeks0 1 folio at 75 cts first insertion and 40 cts. subsequent insertions. Total $1.55 George Nearpass On motion which was duly seconded and carried said bill was allowed and ordered paid May 2nd 1895 Common council City of Marmont to Marmont Hearld Dr. Printing 300 election ticets $2.00 Printing 24 sample tickets $2.00 Total $4.00 Geo Nearpass On motion which was duly seconded and carried said bill was allowed and ordered paid marmont Ind. Mary 5 1895 To the Town Council Dr. to L. C. Patsel $1.50 for work on streets assisting serveyor or April 24th 1895. L. C. Patsel
	On motion which was duly seconded and carried said bill was allowed and ordered paid and the clerk was instructed to draw an order for that amount. And be it further remembered that Henry Zechiel presented a plat of of out lots and asked that the Board exxamine the same and that said lots be made a part of the corporate town of Marmont said addition to be known as the Zechiel addition to Marmont. The Board appointed Marcus F Mosher Samuel E Medbourn and John W Souder a committee to examine said lots and report at next meeting of Board. And be it further remembered that the committee on building of a jail reported contract tet for said building to D. G. Walter said Walter agreeing to do the work on said jail for $2.00 per day per man. Thomas B. Harris agreeing to furnishing the lumber for said building at $1.25 per thousand feet. And be it further remembered that on motion which was duly seconded and carried the clerk was ordered to draw orders for the amount due the different elective officers of the town. 	May 9th 1895 Be it remembered that the town Board of the town of Marmont met in special session on the 9th day of May 1895 at 7 o'clock P.M. in response to the following notice. Notice To Marcus F. Mosher and Samuel E Medbourn that a special meeting of the Board of trustees of the town of Marmont Indiana will be held at the office of J. H. Koontz in said town on the 9th day of May 1895 at 7 o'clock P.M. for the purpose of confirming the election of and accepting the bonds of the lately elected town officers. attest F. L. Carl Clerk John W. Souder Pres May 9th 1895 We hereby acknowledge service of the above notice upon us for the purpose there in expressed Sam E Medbourn M. F. Mosher Present at said meeting John W. Souder Marcus F Mosher and Samuel E Medbourn And be it remembered that Charles Zechiel file his certificate of election as clerk of said town and oath of office therein to attached had and held on the 6th day of May 1895 and by motion which was seconded and carried said certificate was received and ordered made a part of the record and is in the words and figures as follows towit
	Certificate of Election To whom it may concern This is to certify that a regular election held in the town of Marmont State of Indiana on the 6th day of May 1895 Charles Zechiel was duly elected to the office of Town Clerk in and for the said town of Marmont to serve as such for the term of one year and untill his successor is elected and qualifed In witness where of I have hereinto set my hand and seal this 8th day of May 1895 J. F. Koontz, Inspector State of Indiana County of Marshall S. S. I Charles Zechiel do solemnly swear that I weill support the constitution of the United States and the constituiton of the State of Indiana and that I will faithfully and impartially discharge my duty as Clerk of the town of Marmont according to law and to the best of my ability so help me God Charles Zechiel Subscribded and swoen to before me this 9th day of May 1895 Henry M. Beaber was take from the table, and the Board dedcided that the licens of said Beaber could not be transferred, and a motion was made and duly seconded that the clerk notify Mr. Geo W. Gerard to take out a new license. Carrried Be it remembered that a motion was made and duly seconded that a tile pruchae be made to extend from Henry Koontzs building, south intersecting with the tile of John Osbonr. carried Be it furthere rememebred that a motion was made and duly seconded which was also carried that all cross walks running with the sidewalks be made 4 boards wide and all walks exctending across streets connecting sidewalks and not extending in the same direction a the sidewalk be made 3 boards wide. Be it remembered that a motion was made and duly seconded that contracts be let out for the building of cross walks, giving Marshall Gandy the preference, at $3.00 for steet cross walks and $1.50 per walk for cross walks across alleys other wise the contract to be let to lowest bidder provided how ever he is a repiable person. carried And be it further remembered that said board selected and appointed as successor to Geo. Garn as school trustee for said towon to have and to hold said office for three years or until his successor is elected and qualified, the following named person towit John Osborn.
	Be it further remembered that a motion was made and uly seconded, that the money arising from fines be applied to the town of Marmont carried Be it rememebred that a motion was made and duly seconded which was also carried that ordinances be drawn to prohibit fast driving on the street, or cruelty to animals in whateever form may be found to exist and also to prohibit the sale of merchandise upon the street, without first obtaining a license from the town board. I Be it ordained by the common Council of the village of Marmont in Marshall County in the State of Indiana, That any and all licenses which may be issued under and by virtue of any ordinance passed as subkect to amy and all ordinances which may be in force at the fime of issuing said license or wohich may subsequently be passed by said council. Sec. II Every person who may wish to
	obtain a license, shall apply in writing to the village clerk setting therein he number and names of all persons interested; the kind of buisness or following and in all applications for license, stating or fixed buisness shall set forht the proposed place, and such place shall not be changed without an order passed by the common council, nor shall such license be transferrable in any event and no licese shall be granted for longer period than one year Sec III Before any person or persons, firm or corporation may sell, vend or cry any dry goods, staple goods, mechandise or personal property of any description, at auction, or before any person or persons, firm or corporation, echibit any shor or circus performance of any description, within the village of Marmont, as here in before provided; he or they shall make written application to the village clerk of the villahe of Marmon, as herein before , and shall pay to the village tresurer for the use and benedit of said village the sum of five dollars (5.00) per day for each and every day such person or persons desires to be licensed. The term auction as used in this ordinance is understoof to be and mean all sales made to competing bidders, or by selling to the highest of lowest bidders provided, that this section shall not apply to any sales made by any sheriff, cornoer, constable, assignee, Trustee, commissioners, executor or administrator, or any other officer in the discharge of his or their duty * nor to any person or persons selling his or their household goods, or other personal goods and chattels which had heretofore been used by him or them Any person violating any of the provisions of this section, shall from conviction be fined in any sum not less than five
	dollars ($5.00), nor more than twenty five ($25.00) for each and every offence Sec IV No street peddler hawker or other itinerant dealer shall offer for sale either by retail or wholesale in any vechile or otherwise within the village of Marmont, any goods, wares or merchandise, (except produce and meats), without first ontaining drom the village vlerk, as herein before provided, a license therforp and such license shall be for one day or more wohich he shall pay to the village treasurer the sum of one dollar ($1.00) per day for each and every day for which said license is issued; provided that license may issue and be granted to such person or persons for the periof of one year upon applicastion and the payment of one dallar per day as above provided. Sec. V Any person who shall violate any or either of the provisions of this ordiance or any section or any clause or provision or section of this ordinance or who shall neglect or fail to comply with any or either of the requirements there of shall, upon conviction be fined not less then five follard ($5.00) nor more than twenty five dollars ($25.00) Sec. Harris, declared said motion carried and ordered the clerk to publish said ordinance in accornace with said motion Be it also remembered that the following ordinance was presented and read, which ordinance is number seven (7) An Ordinance prohibiting cruelty to Animals Sec. I Be it ordained by the common Council of the village of Marmont, that my person or persons that overdirives, overloads, tortures, torments, or deprives of any necessary sustance, or unncessarily or cruelly beats or neddlessly mutilated or kills any animal or who causes any horses mares or muels or any other animal confined or fastened at any place upon the streets of Marmont without food or water for an unnecessary period shall upon convition be fined not less than five dollars ($5.00) and not more than twenty five dollars (25.00) Sec II And it shall be the duty of the village Marshall to take core of such animals thus neglected, and also arrest said owners of said animals and bring them before the proper authorities for punsihment Sec II And it shall be unlawful for any person to ride or drive any horse mar or mule or any other animal of any kind or discription on or through the streets, alleys, or public highways of the village of Marmont, in a fast or dangerous manner. Any person violating the rules of this section shall upon convition be fined not less than five dollars ($5.00) and not more than twenty five dollars ($25.00) Sec. IV Any person who shall violate any or eithe of the provisions of this
	ordinance, or any section or any clause or provisions or section of this ordinance or who sall meglect or fail to comply with any or either of the requirements thereof Shall upon conviction be fined not less than five dollars ($5.00) and not more than twenty five dollars ($25.00) Sec V This ordinance shall take effect July 25, 1895 Chas. Harris declared said motion carried and ordered it to be made a part of the record Be it further remembered that the following ordinance was presented which ordinance is No 8 An Ordinance for providing for the erection an operation of a telephone exchange or System of Telephones in the the town of Marmont, in Marshall county in the state of Indiana and granting a franchise for the same to the Plymouth telephone company Sec I Be it ordained by the trustees of the Town of Marmont Marshall county Indiana that there there be and is here - by granted to the Plymouth Telephone company, their successor and assigns, the right and privilege of using the streets, alleys and public grounds of said town and also of such territory as my here after be incorporated and included within the limits of said town, and also of such territory as may here - after be incorporayed and included within the limits of said town for erection, construction and maintenance and use of poles, posts, masts, arms, wires, and all other necessary appliances required to perperly and successfull construct and operate a telephone exchamge or system of Telephones in said town Sec. II In the erection of poles, posts, masts, arms and such other appliances as are referred to in Section I of this ordinanace in and on the streets, allesy or public grounds in said Town, the said Plymouth Telephone Company, their successors or assigns shall use reasonable diligence and skill, and
	shall not unnecessarily obstruct the same, or interfere with the usual and ordinary use thereof. Said poles, posts, masts, arms, wires and other appliances shall be so placed as not to endanger or interfere with the useal and ordinary use of any of the buildings in said town nor with any water drain or sewer pipe or with any telegraph property now in said Town and the placing of all poles and posts or other appliances shall be under the supervision and direction of the said board of Trustees. Sec. III The Telephone exchange or system of Telephones and all instuments, appliances and service to be erected, operated and furnished under this ordinance shall be as complete and effiecient as the telephone exchanges, systems, instruments and appliances furnished and in general use Sec IV Said Plymouth Telephone Company their successors or assigns, shall not ber required to make connection with a telephoned owned by any other person, nor furnish sevice for such person when bu so doing the general service will be impaired Sec. V Nothing contained in this ordinance shall be taken or construed to prevent or delay the said Plymouth Telephone company their successors or assigns from constructing, maintaining or operating toll lines in said Town under such restrictions as are herein before provided Sec. VI And it is hereby expressly provided that the said Board of Trustees shall and will at needed times pass such resolutions and by laws ncessary to fully protect the property and rights of the said Plymouth Telephone Company and further that the violation of the conditions and stipulatins of this ordinance by the said Plymouth Telephone Company shall operate as a forfieture of their rights and privileges hereunder

Tibbetts, his attorney, and submits to the Board his addition to the Town of Culver City (formerly Marmont) of Marshall county Indiana and asks that the same be confirmed and approved by said board of Trustees of said town And the Board now apponts James H. Castleman as a special committiee to examine said plat and said committes is directed to report at the presetn meeting of the said board of Trustees. The said committee comes now and reports on said matter as follows: To the Honorabe Board of Trustees of Culver City, (formerly Marmont) Marshall county Indiana Your committee to whom was referred the matter of the Plat of Harris' addition to said town, comes now and reports that he has examinded said plat and that he is well qcquainted with the gorund platted, and that said plat is in all things regular correct and proper and recommends that the same be confrimed and approved, and accepted by this board as an addition to said town. 	Upon the report of said committe James H. Castleman a member of said Board offers the following resolution and moves its adoption which motion is seconded by T. B. Harris, a member of said board Whereas James H. Castleman, the special committe to whom was referred the plat of Harris' Addition to the town of Culver City (formerly Marmont) had made by his report that he has made due examination of said plat and is will acquainted with the ground platted and recommends the adoption of the said plat be and is hereby in all things accepted by the board of Trustees of said Town. Upon the adoption of said resoultion those voting in the affirmative were James H. Castleman and T. B. Harries. There being no votes in the negative the president of the Board declared said reolution carried and adopted and said plat approved confirmed, adopted and accepted. 	Culver City, Dec 16, 1895 Be it remembered thar the town Board of the town of Culver City (Formerly Marmont) Indiana met in Regular session at T. B. Harris' office, at 7 o'cloks P. M. on the 16th day of December 1895 and there were present at said meeting, Trustees E. W. Geisleman, J. H. Castleman and T. B. Harris The minutes of the previous meeting were read and approved Be it further remembered that a motion was made by trustee Castleman which motion was also duly seconded by Trustee Geiselman, that the clerk issur an order of Two Hundred and sixty dollars in favor of Mr. Bass fot the pay't of lots Nyumber 4 & 5 The yaes & nays were taken upon said motion and upon roll call, Trustees, E. W. Geiselman, J. H. Castleman and T B Harris voted in the affirmative, and the president T B Harris declared the motion carried and instructed the clerk to issue such order in accordance with said motion. On motion said Board adjourned Chas. Zechiel, Clerk T. B. Harris
